DHCD Issues Proposed Amendments to Chapter 40R Regulation - July 12, 2013

The Massachusetts Department of Housing and Community Development (DHCD) issued proposed amendments to the Smart Growth Overlay District (Chapter 40R) regulation  (760 CMR 59.00) today.  It will hold a hearing on the proposed amendment on August 13 and will accept written comments through that date as well, as detailed in the below notice.

PUBLIC NOTICE

DEPARTMENT OF HOUSING & COMMUNITY DEVELOPMENT (DHCD)

Under the provisions of M.G.L. c. 30A, § 2, notice is hereby given of the proposed promulgation of amendments to regulation 760 CMR 59.00 – Smart Growth Zoning Overlay District (C. 40R). DHCD’s regulatory authority for this action is provided under Section 92 of Chapter 149 of the Acts of 2004; M.G.L. c. 40R; M.G.L. 23B. In accordance with M.G.L. c. 30A, § 5, the proposed amendments and the regulation do not have a Small Business Impact.

DHCD will hold the following public hearing:

                        Tuesday, August 13, 2013 10:00 AM to 12:00 PM

At such time and place interested persons will be afforded an opportunity to present oral testimony.  Written comments may be presented at the hearing or at any time prior to the hearing by directing the same to the DHCD, 100 Cambridge Street, Suite 300, Boston, MA  02114, ATT:  Elaine Wijnja or sent electronically to elaine.wijnja@ state.ma.us .
