President Obama signed S. 896 on May 20, 2009. This bill includes a nationwide 90 day preeviction notice requirement for tenants in foreclosed properties. The provisions of the bill are effective on enactment, May 20, 2009.
Specifically, the new law will require that the immediate successor in interest at foreclosure

Senate Budget Amendment Restores Majority of Housing Cuts
On May 19th, the Senate passed an amendment that would partially restore many of the cuts proposed for affordable housing programs in the Senate Ways and Means budget. The funding restorations were made possible by a vote to raise the Sales Tax to 6.25%. Absent new revenues, the cuts to these programs would have been even more devastating. The following increases were made:

HUD and the Treasury Department issued guidance on the Tax Credit Assistance Program (TCAP) and the Low Income Housing Tax Credit Exchange Program (“Section 1602”) on May 4, 2009. They held a joint webcast on May 6 to discuss the programs and issues that will be addressed through further guidance and/or “Q and A” websites. Both agencies emphasized the importance of meeting commitment and spending deadlines. Treasury was represented on the webcast by Jean Whaley and HUD by Marcia Sigal.

WASHINGTON – With the Making Home Affordable (MHA) program delivering much-needed relief to homeowners and to our economy just over two months after the release of program guidelines, Treasury Secretary Tim Geithner and Housing and Urban Development (HUD) Secretary Shaun Donovan today provided an update on the program’s impact on stemming the housing crisis and keeping families in their homes and announced new options for homeowners facing foreclosure.

The Recovery Act is designed to stimulate the economy through measures that, among other things, modernize the Nation's infrastructure, jump start American energy independence, and protect those in greatest need. Green Building is an approach to sustainable development that is designed to result in a property that reduces energy demand, costs less to operate, improves the residents’ quality of life, and reduces its impact on the environment. Issuance of the Notice implements the Green Retrofit Program.
